Michigan injury attorney Steve Gursten is speaking at the American Association for Justice Legal Seminar on maximizing pain and suffering compensation in auto accident lawsuits
This week, I’ll be in New Orleans presenting to my fellow injury attorneys on how to recover full and fair compensation for their clients in in car accident cases. As most personal injury attorneys woefully undervalue cases (according to many studies), the main thrust will be how these lawyers can get the highest settlement possible for a deserving client in need.
This legal presentation is part of the American Association for Justice “Jazz Fest” Seminar. The subtitle is “It’s all about the damages (pain and suffering compensation and settlements) for lawyers litigating auto crash cases.
There really are no magic bullets, no shortcuts or tricks for any lawyer trying to recover a higher injury settlement for an injured client. Simply put, it’s up to every injury attorney who has a duty and responsibility to his or her client to demonstrate to an insurance company or a jury how a car crash has changed someone’s life. Injury attorneys must also be able to show how ALL the injuries are and will effect someone over the course of a lifetime to get a fair recovery. That takes a lot of work, and it takes hundreds of hours of learning the medicine for a lawyer to be able to do effectively.
During my presentation, I will discuss computer claims software programs such as Colossus, which are being used by the insurance industry today to improperly calculate the value of auto accident settlements and then low-ball car accident injury victims. Attorneys must be familiar with these insurance company tactics to protect their clients.
I will also cover the importance of showing and documenting the critical effects of injuries that are often overlooked by inexperienced injury attorneys, injuries like chronic pain syndrome and traumatic brain injury. New research shows that chronic pain is a debilitating injury, and not just a symptom or a side effect of other injuries.
