Michigan Lawyers Weekly outlines a confidential truck accident case, where a plaintiff’s vehicle was struck by a delivery truck. The plaintiff had neck surgery and after seven months of disability, returned to work at the U.S. Postal Service. He was involved in a prior auto accident and underwent surgery as a result.
The defendant contended the plaintiff’s back and neck injuries were from prior medical history and the previous auto accident. Gursten asserted that the defendant is liable for aggravation of the pre-existing condition and that the surgeries were related to the most recent truck accident.
