What if I am Accepted for Social Security Disability (SSD)?

If someone is accepted for Social Security Disability after an automobile accident, the injured person must re-pay the insurance company for any SSD he does receive dating back to the date of approval. The insurance company, however, is under no obligation to refund any of the policyholder’s premiums for which coverage is no longer applicable. Additionally, if the accident victim was receiving any kind of short-term disability from his employer, both the short-term disability insurance company and the automobile insurance company are entitled to repayment. This situation leaves the victim having to payback double any amount he has ever received.

While the injured person is fighting his own insurance company, the person who caused the accident also is winning against the victim. In a normal case, a negligent driver is responsible for any wage loss past the first three years of the accident. If a car accident victim is approved for SSD, however, the negligent driver is entitled to an offset from the damages he caused. In other words, the public taxpayers are made to pay for the actions of a person who causes an accident.
