Whenever there is a catastrophic accident resulting in injuries such as traumatic brain or spinal cord injuries, the person that is injured, their family members and their health care professionals face the difficult task of identifying private health insurance benefits, governmental benefits, special education benefits, and disability benefits. Without obtaining your entire health insurance policy it is difficult to understand what benefits you are entitled to. This policy is often called the Master Provider Agreement or Master Contract. Each health insurance company writes their own agreement or contract and each managed care insurer or other health insurance company sets forth its own definitions under their policy.

Send a request to the insurance company by certified mail.
Have your health care provider call the insurance company.
Have your advocate or attorney call and write the insurance company.
Contact your state legislator or senator for assistance.
Know your rights and fight for your benefits…
Communicate your needs to your health care provider and enlist their assistance.
Verify health insurance coverage in writing.
Obtain your Master Provider Agreement / Contract and read it carefully.
Determine the appeals procedure and appellate time periods prior to pre-certification or payment decisions.
If the requested benefit is denied, obtain the specific reason for the denial in writing from the insurance company. The burden of proof is the responsibility of the insurance company.
Assert you health insurance appellate right. All internal appeals must be exhausted before an external appeal can be taken.
Provide the health insurance company with requested medical records but not unlimited access to team meetings, treatment sessions, or discussions with your physician without a representative present.
Reports of the treating physician should specifically refer to the language in your policy. Discharge planning should begin at the time of admission.
