Who Pays For No-Fault Property Protection Insurance (PPI) Benefits?

Attorney Commentary on No-Fault Statute: MCL 500.3125

Property benefits; order of priority

Just as there is an order of priority to recover Michigan no-fault benefits when there is personal injury following an auto accident, there is also an order of priority for claiming property damage, also known as PPI benefits.

An individual whose property has been damaged as a result of a motor vehicle accident should first pursue PPI benefits with the no-fault insurer of the “owners or registrants of vehicles involved in the accident.” If no-fault insurance is not available through the owners or registrants, the individual whose property was damaged should look to the “insurers of operators of vehicles involved in the accident.”

In summary, the order of priority is as follows:

· First Priority - No-fault “insurers of owners or registrants of vehicles involved in the accident.”

· Second Priority - No-fault “insurers of operators of vehicles involved in the accident.”
