No Fault overhaul bill HB 4612 may be in jeopardy

Michigan Auto Law was interviewed by Michigan Lawyers Weekly on what may come of Gov. Snyder’s drastic No Fault “reform” bill, HB 4612.

Opponents, mainly Democrats, health care organizations and injury lawyers, have squared off against proponents that mainly include Republicans and the auto insurance industry.

The bill would cap the current unlimited medical benefits for catastrophic no-fault claims at $1 million, along with other major changes. For more information about HB 4612, and how it would affect auto accident victims, visit our Michigan No Fault Reform Resource Center.

Our attorney told Michigan Lawyers Weekly that the bill is likely “going to lie on the floor for the rest of the term.”

“[The legislation] is such an overreach; there is nothing in the bill to negotiate.The only things that could survive [are] some kind of cap and some kind of balanced fraud program — it would have to be balanced and must address fraud by the public but also must address fraud by the [insurance] industry.”
