I’ve been injured in a motorcycle accident. Who will cover my No-Fault insurance benefits?

I’ve received a few foll
ow-up e-mails from my last blog on motorcycle accidents, and they all essentially ask the same question: What order of priority does a person who has been injured in a motorcycle accident turn to for No-Fault insurance benefits? I’ve decided to write my response here, so it will be easy for anyone injured in a motorcycle crash to know where to turn to for insurance benefits.
1. The first order of priority after the motorcyclist involved in an accident with a car or truck will be with the owner of the automobile involved in the accident. This is according to MCL 500.3114. If the vehicle is not insured, then go to:
2. The driver of the automobile involved in the accident, if the driver is different from the owner. If the driver is uninsured, then go to:
3. The motorcycle driver’s auto insurer - if the driver of the motorcycle also owns an automobile and is a “named insured” on an auto insurance policy. If the motorcycle driver has no auto insurance, then go to:
4. The motorcycle owner’s auto insurer - if the owner of the motorcycle also owns an automobile, and is a “named insured” on an auto insurance policy. If the motorcycle owner has no auto insurance, then go to:
5. The Michigan Assigned Claims Facility. The state of Michigan will then assign an insurance company to handle your No-Fault claim.
