Pediatric Traumatic Brain Injury to be Addressed by Congress

October 12, 2009 by Steven M. Gursten

As an attorney handling serious car and truck accidents, I would estimate approximately 50 percent of my cases involve a traumatic brain injury component. TBI is something that I and the other lawyers here feel strongly about, which is why we often speak at seminars and lawyer education programs around Michigan and the country, helping people who have suffered traumatic brain injury after an accident. Many people with TBI are ignored or receive poor follow-up care, and many attorneys simply do not understand the underlying medicine to be able to properly protect them.

As the first Michigan brain injury attorney to serve on the legal committee for the Sarah Jane Brain Project — a foundation that’s creating a model treatment system for children suffering from pediatric acquired brain injuries — I’m happy to report we will introduce a groundbreaking resolution in the House and Senate this week.

Pediatric Traumatic Brain Injury

The resolution recognizes pediatric brain injury as the leading cause of death and disability in the United States for children and young adults, and endorses the National Pediatric Acquired Brain Injury Plan to develop a seamless, standardized, evidence-based and accessible system of care for all of these children, young adults and their families. Here is the full resolution.

As of now, we have Representatives from more than 20 states and territories who have already agreed to sign on as original co-sponsors. Michigan does not have a co-sponsor yet.

As someone who has seen how TBI after an auto accident can turn lives upside down, I believe there isn’t a single member of Congress, or any Michigan resident, who should be opposed to this measure. Keep in mind, the resolution does not appropriate funds or change laws; but once it’s passed, my hope is that it will forever change the political landscape of pediatric brain injury. Congress would endorse the traumatic brain injury plan we have created and encourage federal, state and local governments to implement it as the way to prevent and treat all brain injuries in children.

It is an honor to be part of the Sarah Jane Brain Project, and I sincerely hope our government finds this cause to be truly important. In November, I will be meeting with other representatives from the Sarah Jane Brain Project in New York, and I hope to return and report good news on this vital medical front to protect young victims and provide them the care and medical resources they need to make the best recoveries possible.
