I currently have a client who sustained a serious traumatic brain injury and was almost killed by a trucker whose CDL was suspended — 11 times. Last year, I represented the family of a wonderful husband and father who was killed in Detroit by a fully-loaded gravel hauler with five safety violations and a driver on epilepsy medication. As a truck accident lawyer, neither case is surprising.

Adrian Daily Telegram: Lenawee County Car Accident Victims Awarded More than $2 Million

On Sept. 16, the Adrian Daily Telegram wrote an article about my partner David E. Christensen’s trial in Lenawee County Circuit Court for a car accident case. The case resulted in a $2,091,500 jury verdict for our clients Douglas and Tammy Mayher.

In October 2005, Douglas Mayher, his pregnant wife Tammy and her 9-year-old son were stopped at a stop sign on Palmer Highway at M-50, when a negligent teenage driver with a car full of girlfriends passed a truck on the right gravel shoulder, lost control and crashed into the family’s Yukon. The Yukon flipped over and Douglas Mayher had to be removed by the Jaws of Life. He was taken to University of Michigan hospital by helicopter to treat his traumatic brain injury and shoulder injuries.

Detroit is a dangerous place to drive. Based upon a national survey of automobile crash deaths, Detroit, Michigan ranked as the 9th deadliest city in America according to a NHTSA report of fatal car accidents from around the country.

Our auto accident lawyers help many people who have been seriously injured in the Detroit metro area, and Michigan Auto Law opened a law office on Woodbridge Street, in downtown Detroit several years ago to better service our clients.

Last year, I wrote about Detroit’s top five worst intersections. Today I’m updating that information with five more intersections with much higher car accident numbers, based upon SEMCOG’s newest 2008 statistics.

Lawyers Look to Insurance Commissioner to Prevent Set-off Scams

Yesterday, I wrote about what happened to my client, Amie Carducci. Amie received nothing from her auto insurance company - even though she sustained horrific personal injuries in a car crash and had purchased uninsured motorist coverage to protect herself. This is because Progressive Insurance relied on a “set off” provision to avoid paying Amie her uninsured motorist coverage. I consider this one of the most unjust things I’ve witnessed as a no-fault insurance lawyer in Michigan. I’ll be testifying before the Michigan Legislature on Sept. 29, with hopes they will rule that insurance companies cannot put set offs in their provisions.

The “Set Off” Insurance Company Scam

This “set off” scam allowed Progressive Insurance Company to cheat a young school teacher who was critically injured in a very serious car accident. Beware, because your insurance company may have policy language allowing it to pull the same scam on you.

My client Amie Carducci was only 28 when she was struck nearly head-on by an uninsured driver. She had 13 surgeries, including an emergency six-level fusion surgery to her lumbar spine immediately following her auto accident. Amie spent nearly a month in the hospital, and has no memory of the crash due to her traumatic brain injury. Before her crash, Amie was a serious athlete and runner. She is a very sweet young woman who was beginning a career as a teacher.

Michigan Auto Law Clerk Saves Man From Being Run Over

I am proud to say our law firm is home to a hero. This week, our clerk Jon O’Neill saved a man from being run over by a pickup truck.

When Jon was running errands, he saw from a distance a man running next to a red truck — heading south on northbound Telegraph and Civic Center Drive. Suddenly, the man fell and was being dragged by the pickup.

But Jon didn’t think twice about running through traffic toward the man in distress. He quickly jumped into the front seat of the truck, laid on the brake and stopped the automobile from running over this man.

The Dirtiest Insurance Company Trick of All

Would we ever let a lawyer stand up in court and knowingly and intentionally mislead a jury?

Yes. It happens all the time.

And unfortunately, it just happened again.

Farm Bureau Insurance recently forced my partner, David E. Christensen, to try a serious auto accident injury case in Lenawee County, Mich.

The defendant was an 18-year-old girl.  Of course, she wasn’t the real defendant.

Michigan Auto Law Attorney David Christensen Receives $2 Million Verdict

Yesterday, my partner, attorney David E. Christensen, received a jury verdict of $2 million in Lenawee County, Michigan. This is the largest verdict recently recovered in that county, and is the result of a car accident that occurred in Adrian more than four years ago.

Congratulations to Douglas and Tammy Mayher. Mr. Mayher was struck by a negligent driver and suffered serious injuries, including a traumatic brain injury and a shoulder injury that required surgery.

I am especially pleased for our clients, because the defendant’s auto insurance company, Farm Bureau, pulled nearly every dirty trick in the book to try to escape responsibility for this case.

Michigan Attorney says Time to Put the Brakes on Dangerous Trucks

An online legal news publication called lawyersandsettlements.com recently published a story about my continuous work as a truck accident attorney to raise awareness on dangerous trucking companies throughout the country.

I released a Federal Motor Carrier Safety Administration report to the media listing more than 1,000 Michigan truck companies that are breaking safety laws. And as past-president of the Interstate Truck Litigation Group for the American Association for Justice, I asked the AAJ to use my idea on a national scale. This resulted in the analysis of more than 1 million lines of data, concluding there are 28,000 trucking companies in the U.S. violating federal safety laws.

Car Accident Lawyer Predicts Kreiner v. Fischer Change with McCormick v. Carrier - a Second Chance for Auto Accident Victims

Recently, I’ve been writing about McCormick v. Carrier (Rodney McCormick v. Larry Carrier and Allied Automotive Group, Indemnitor of General Motors Corp.), the Michigan Supreme Court case that car accident attorneys and judges are hoping will finally reverse Kreiner v. Fischer. On Monday, Michigan Lawyers Weekly wrote a story on the possibilities McCormick could bring, and interviewed me as an expert. I believe if McCormick prevails, auto accident victims who have had their rights ravaged by Kriener for the past four years will finally have a chance.
