FTCA Claims Involving Car Accidents in Michigan with the Government

A recent case shows how dangerous it is when anyone injured in a car accident with a US postal truck, or any car or truck owned and operated by the federal government (DEA, ATF, FBI, etc) does not comply with the requirements of the Federal Tort Claims Act (FTCA).  Unlike all other car accidents and truck accidents in Michigan, which have a 3 year statute of limitations to hire a lawyer and file a lawsuit, with no required period to give notice of the injury and accident, claims against federal government vehicles must adhere to a more stringent set of rules.

Hospitals and Patients at Risk after Automobile Accidents in Michigan

Helping people who have been injured in car accidents throughout Michigan, our lawyers have found that some hospitals, for example Bronson Methodist Hospital in Kalamazoo, Sparrow Hospital in Lansing, and Munson Medical Center in Traverse City, do not always aggressively follow-up with auto insurance companies for payment of medical bills for people who have suffered personal injury from automobile accidents. Now, after a recent order by the Michigan Supreme Court, these hospitals may be putting these people at personal risk for their own medical bills.

This change, based upon an order from the Court dated March 7, 2008, will dramatically impact hospitals and doctor billing practices in automobile accident cases throughout Michigan.

This is a question that lawyers should be exploring after a new safety recommendation issued in April that could have important legal ramifications for truck accident lawyers in Michigan.   The Medical Review Board of the Federal Motor Carrier Safety Administration (FMCSA) has proposed testing overweight truck drivers for sleep apnea, and to suspend these truck drivers until they receive treatment.
