MICHIGAN MOTORCYCLE INSURANCE LAW
NO FAULT ORDER OF PRIORITY

If a motorcycle rider is involved in a motorcycle accident and is entitled to Michigan No Fault insurance benefits, what insurance will he or she turn to?

The first order of priority after the motorcyclist involved in a motorcycle accident with a motor vehicle will be with the owner of the automobile involved in the accident with the motorcycle.

There is no resident relative option for motorcycle claimants, as there is normally in Michigan for people injured in car accidents under Michigan auto no fault.

The priorities for motorcycle claimants are therefore as follows:

Through the owner of the automobile involved in the accident, if the vehicle was not insured, then go to 2.
Through the driver of the automobile involved in the accident, if different from the owner. If the driver is uninsured, then go to 3.
If the driver of the motorcycle also owns an automobile, and is a “named insured” on a policy of auto insurance, through the driver’s auto insurance. If the driver has no auto insurance, then go to 4.
If the owner of the motorcycle also owns an automobile, and is a “named insured” on a policy of auto insurance, through the owner’s auto insurance. If the motorcycle owner has no auto insurance, then go to 5.
Through the Assigned Claims Facility. The State of Michigan will then assign an insurance company to handle your no fault claim.
