Michigan No-Fault Insurance Law History

The Michigan Legislature enacted no-fault insurance laws in 1973, requiring that all vehicles be insured with at least a minimum amount of coverage. The Michigan No-Fault Act sets out what coverage must be purchased, and outlines minimum amounts for required coverage. They also set out parameters for allowable lawsuits against third parties. The thinking behind the 1973 enactment was that many of those severely harmed in car accidents were often under-compensated and the poor were forced to settle for lesser amounts than they were due because of economic necessity.

By requiring coverage — guaranteeing that injured parties could recoup monetary losses associated with their injuries — the State of Michigan endeavored to create a more balanced approach. In other states where the tort system prevails, drivers involved in auto accidents often have to go after the other driver’s insurance carrier to get full compensation for their losses.
